NMPCA Job Board — Terms of Service

Effective Date: October 1, 2026

Welcome to the New Mexico Community Health Center Job Board. The Job Board is a workforce resource intended to connect job seekers with employment opportunities at community health centers and other participating healthcare organizations.

These Terms of Service (“Terms”) govern your access to and use of the New Mexico Community Health Center Job Board. By accessing or using the Platform, you agree to these Terms. If you do not agree, please discontinue use of the Platform.

For purposes of these Terms, “NMPCA,” “we,” “us,” or “our” refers to the New Mexico Primary Care Association. “User” refers to anyone accessing or using the Platform, including job seekers, employers, and other visitors.

1. Purpose of the Job Board

The New Mexico Community Health Center Job Board is intended to support healthcare workforce recruitment by making employment opportunities more accessible to individuals interested in working at community health centers and other participating healthcare organizations.

NMPCA provides the Platform as a workforce resource. NMPCA is not an employer, staffing agency, or recruitment firm for positions listed by participating organizations and does not act as an agent for job seekers or employers.

NMPCA does not make hiring decisions, employ candidates on behalf of participating organizations, or guarantee that any listed position will result in employment.

2. Account Registration and Responsibilities

Certain features of the Platform may require users to create an account.

Users agree to provide accurate, current, and complete information when registering for an account and to update that information as necessary.

Users are responsible for maintaining the confidentiality of their account credentials and for activities conducted through their accounts. Users should promptly notify NMPCA of any suspected unauthorized access to their accounts.

NMPCA reserves the right to suspend or restrict accounts that violate these Terms, provide false information, or misuse the Platform.

Employer Accounts

Employers must be authorized to represent the organization associated with their account. Employers are responsible for ensuring that individuals who access or manage their employer accounts have appropriate authorization.

NMPCA may request additional information to verify an employer's identity or eligibility to participate in the New Mexico Community Health Center Job Board.

3. Job Listings and Employer Responsibilities

Employers are responsible for the accuracy, completeness, and legality of job postings submitted to the Platform.

Employers agree to:

  • Provide truthful and current information about job openings, including job titles, employer names, work locations, job requirements, and application instructions.
  • Ensure that job postings comply with applicable federal, state, and local laws, including applicable employment discrimination, wage and hour, and pay transparency requirements.
  • Post only legitimate employment opportunities for which they are authorized to recruit.
  • Update, remove, or notify NMPCA of positions that have been filled, closed, or materially changed.
  • Ensure that application links and contact information are accurate and functional.
  • Refrain from posting misleading, discriminatory, fraudulent, or otherwise unlawful content.

NMPCA reserves the right to review, correct, decline, remove, or restrict access to job postings that appear inaccurate, outdated, misleading, inappropriate, or inconsistent with these Terms.

NMPCA's review of a job posting does not constitute verification of the employer, the position, or compliance with applicable law.

4. Automated Job Feeds and Third-Party Listings

The Platform may display job postings submitted directly by employers or obtained through automated feeds, integrations, or other authorized sources.

Automated listings may be imported from employer career websites, applicant tracking systems, or other sources. The availability and accuracy of imported information may depend on the source system and the functionality of the applicable integration.

Although NMPCA may take reasonable steps to maintain accurate and current listings, automated updates may be delayed or may not capture every change made by the original source.

Employers participating through automated feeds remain responsible for the accuracy and currency of their employment opportunities and should notify NMPCA of material listing errors or removal issues.

Job seekers should confirm that a position remains available and review the employer's official application instructions before applying.

5. Job Applications and Hiring Decisions

The New Mexico Community Health Center Job Board may allow job seekers to browse opportunities, access employer application links, or use other application-related features made available through the Platform.

Unless a specific application feature is expressly provided by the Platform, applications are submitted directly to the employer or through the employer's designated application system.

Job seekers are responsible for ensuring that information they submit to employers is accurate and truthful.

Employers are solely responsible for their recruitment processes, applicant screening, interviews, employment offers, hiring decisions, and communications with applicants.

NMPCA does not guarantee the availability of a position, the accuracy or completeness of every listing, the qualifications of an applicant, or the outcome of any hiring process.

NMPCA does not endorse or guarantee any employer, job seeker, or employment opportunity solely because it appears on the Platform.

6. User Content and Intellectual Property

Users may submit or provide content through the Platform, including job descriptions, employer information, resumes, application materials, and other content supported by the Platform (“User Content”).

Users retain ownership of their User Content, subject to any rights held by third parties.

By submitting User Content, users grant NMPCA a non-exclusive, royalty-free license to host, store, reproduce, display, and process that content only as reasonably necessary to operate, maintain, secure, and provide the intended features of the Platform, subject to the NMPCA Privacy Policy and applicable law.

NMPCA will not obtain a general right to use resumes or application materials for unrelated promotional purposes merely because they are submitted to the Platform.

Users represent that they have the necessary rights and authorization to submit the content they provide and that their submissions do not unlawfully infringe the rights of others.

NMPCA may remove User Content that violates these Terms or applicable law.

7. Prohibited Activities

Users agree not to:

  • Post fraudulent, misleading, unlawful, or discriminatory job listings or other content.
  • Misrepresent their identity, qualifications, employer affiliation, or authorization to post a position.
  • Use the Platform to harass, threaten, exploit, or unlawfully discriminate against others.
  • Collect, copy, distribute, or misuse personal information obtained through the Platform without appropriate authorization.
  • Use another user's account or attempt to gain unauthorized access to accounts, systems, or data.
  • Introduce malicious software, interfere with Platform operations, or attempt to compromise its security.
  • Use bots, scrapers, or other automated methods to collect information from the Platform without prior authorization.
  • Use the Platform for unlawful purposes or in ways that infringe the rights of NMPCA, other users, or third parties.
  • Circumvent access restrictions or use the Platform in a manner that materially disrupts its intended operation.

NMPCA may investigate suspected violations and take appropriate action, including removing content, restricting access, or suspending accounts.

8. Privacy and Personal Information

NMPCA's collection, use, storage, and disclosure of personal information in connection with the Platform are described in the NMPCA Job Board Privacy Policy.

Users should review the Privacy Policy to understand how information may be handled.

Job seekers should exercise care when submitting resumes, contact information, and other personal information. Employers are responsible for appropriately handling applicant information they receive and for complying with applicable privacy, employment, and data protection requirements.

NMPCA does not guarantee the security of information transmitted or stored through the Platform. Users should not submit sensitive personal information unless the relevant feature specifically requires it and the submission is appropriate.

9. Third-Party Websites and Services

The Platform may contain links to third-party websites, including employer career pages, applicant tracking systems, and external application portals.

These websites and services are operated by third parties and may be subject to separate terms of service and privacy policies.

NMPCA does not control and is not responsible for the content, availability, security, privacy practices, or application processes of third-party websites. A link to an external website does not constitute an endorsement by NMPCA.

Users access third-party websites at their own discretion and should review the applicable terms and privacy notices before submitting information.

10. Platform Availability and Changes

NMPCA may update, modify, suspend, or discontinue portions of the Platform, including specific features, integrations, or services, as reasonably necessary for maintenance, security, operational needs, or program changes.

NMPCA will make reasonable efforts to address significant technical issues but does not guarantee uninterrupted access or that all Platform features will always be available.

NMPCA may temporarily restrict access to the Platform for maintenance, security concerns, or other operational reasons.

11. Disclaimer of Warranties

To the maximum extent permitted by applicable law, the Platform is provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied.

NMPCA does not warrant that the Platform will be uninterrupted, error-free, completely secure, or free of inaccurate or outdated listings.

NMPCA does not guarantee employment outcomes, the availability of positions, the accuracy of information provided by third parties, or the performance of external websites and application systems.

Nothing in these Terms excludes or limits any warranty or right that cannot lawfully be excluded or limited.

12. Limitation of Liability

To the maximum extent permitted by applicable law, NMPCA will not be liable for indirect, incidental, special, consequential, or punitive damages arising from or related to the use of, or inability to use, the Platform.

To the maximum extent permitted by applicable law, NMPCA will not be responsible for employment decisions, hiring outcomes, employer conduct, job seeker conduct, third-party content, or the operation of external websites and application systems.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.

13. Indemnification

To the extent permitted by applicable law, users are responsible for claims, losses, liabilities, and expenses arising directly from their unlawful use of the Platform, their violation of these Terms, or their infringement of third-party rights.

Any indemnification obligation will apply only to the extent permitted by applicable law and will not require a user to indemnify NMPCA for NMPCA's own negligence, willful misconduct, or other conduct to the extent such indemnification is prohibited by law.

14. Suspension and Termination

NMPCA may suspend, restrict, or terminate a user's access to the Platform if NMPCA reasonably determines that the user has violated these Terms, engaged in fraudulent or unlawful conduct, compromised Platform security, or misused the Platform.

Users may discontinue their use of the Platform at any time. Users who wish to close an account or request assistance with account-related information may contact NMPCA using the contact information below.

Termination of access does not automatically require the deletion of records that NMPCA is permitted or required to retain under its Privacy Policy or applicable law.

15. Governing Law

These Terms will be governed by the laws of the State of New Mexico, without regard to its conflict-of-law principles, except where applicable law requires otherwise.

Any dispute concerning these Terms will be addressed in a court of competent jurisdiction as permitted by applicable law.

16. Changes to These Terms

NMPCA may revise these Terms from time to time to reflect changes to the Platform, its operations, or applicable legal requirements.

Updated Terms will be posted on this page with a revised effective date. Where required by applicable law, NMPCA will provide additional notice or obtain consent for material changes.

Continued use of the Platform after revised Terms become effective constitutes acceptance of the updated Terms to the extent permitted by applicable law.
